Terms of Use
The agreement that governs your access to and use of SpinIt, including accounts, storage and public sharing.

Important notice
These Terms of Use (“Terms”) are a legal agreement between you and SpinIt, the operator of www.spinit.to (the “Site”), governing your access to and use of the Site, the SpinIt random picker wheel, accounts, browser and cloud storage, public sharing, and related services (together, the “Service”). Please read them carefully.
By accessing or using the Service, creating an account, or publishing a shared wheel, you agree to these Terms and acknowledge the Privacy Policy and Cookie Policy made available on the Site. If you do not agree, do not use the Service.
If you use SpinIt for an organisation, school, business, event, team or other person, you confirm that you have authority to accept these Terms for them. In that case, “you” includes that organisation or person.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited under the laws that apply to you.
At a glance
This summary helps explain the Terms but does not replace them. If it conflicts with the rest of the Terms, the rest of the Terms controls.
- You may use SpinIt without an account for many features. Cloud saving and account management require a registered account; guest sharing may require a human-verification check.
- Browser-saved wheels and drafts depend on your device and browser. Clearing site data, using private browsing, changing devices or browser restrictions can remove them.
- A share link publishes a snapshot that anyone with the link may access. Do not put confidential, sensitive or unlawfully obtained personal information in a shared wheel.
- SpinIt can use equal chances or creator-set weights. It is not a certified drawing, gambling, election, admissions, employment or other high-stakes decision system.
- You keep ownership of your content, but you give SpinIt the limited rights needed to store, process, display and share it as you direct.
- We may restrict accounts, revoke links or remove content when necessary to protect users, enforce these Terms or comply with law.
1. Eligibility and use by minors
You must be legally capable of agreeing to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you and supervise your use.
The Service is not directed to children under 13, and children under 13 must not create an account or publish a public share link. A teacher, parent or other responsible adult may operate the Service in a supervised classroom or family setting and is responsible for obtaining any permissions required before entering a child's name, image or other personal information.
You must not use the Service if applicable law prohibits you from receiving it or if SpinIt has previously suspended or banned you, unless SpinIt has expressly restored your access.
2. What SpinIt provides
SpinIt provides an online tool for creating and customising picker wheels, importing lists, applying equal or weighted chances, spinning for results, recording session results, removing winners, saving or exporting wheels, and sharing wheel snapshots by link. Features may differ by device, browser, location, account state, plan, configuration and release stage.
Some features may be labelled beta, preview, coming soon or experimental. They may be incomplete, change without notice or be removed. Templates, paid upgrades and other announced features are not part of the Service until actually made available.
3. Accounts and account security
You may use many features without registering. To use account features, you must provide accurate and current information, keep your sign-in credentials confidential, and use an email address you are authorised to use. Display names must not impersonate another person or mislead users about your identity or affiliation.
You are responsible for activity carried out through your account and devices, except to the extent caused by SpinIt's breach of duty. Notify support@spinit.to promptly if you suspect unauthorised access. Do not share passwords or use another person's account without permission.
Email confirmation, password rules, rate limits and re-authentication may be required. Pending-confirmation, expired-session, suspended, banned or deletion-pending accounts may have cloud saving, sharing, profile changes or other functions restricted. SpinIt's backend account state is authoritative.
Signing out from one browser may not sign you out elsewhere unless the Service expressly says it does. Password changes or security actions may invalidate other sessions.
4. Wheel creation, imports and results
You may type or paste entries, import supported text or CSV files, load a .spinit file, and add supported images. You are responsible for checking imported data, duplicate entries, weights, settings, file contents and wheel appearance before spinning or sharing.
Duplicates may be preserved and can increase the practical chance associated with the repeated value. In advanced mode, weights deliberately change probabilities. Remove-winner settings, manual removal, edits and overwrites can change later results. The results list is a convenience record and is not an independently audited record.
Do not upload malicious files, files that exceed limits, or content you are not entitled to use. SpinIt may reject, resize, transform, scan, quarantine or remove files for security, compatibility, storage or legal reasons.
5. Randomness, weights and important decision limits
For equal-weight wheels, entries are intended to receive equal selection chances. For weighted wheels, the selection chance is intended to be proportional to the weight configured by the wheel creator. Winner selection is performed separately from the visual animation so animation performance should not determine the selected result.
However, no software system is infallible. Browser limitations, configuration errors, duplicate entries, altered weights, bugs, device failure, network issues or misuse may affect the process or its presentation. SpinIt does not warrant that a result is statistically perfect, independently auditable, tamper-proof, legally compliant or suitable for any particular drawing.
You must not rely on SpinIt as the sole decision-maker for matters involving legal rights, safety, medical treatment, credit, insurance, employment, education admissions or discipline, elections, regulated gambling, financial products, or other decisions that may materially affect a person. Use an appropriate independent process and human review.
6. Raffles, giveaways, prizes and promotions
SpinIt is a tool, not the organiser, sponsor, judge or administrator of any raffle, giveaway, contest, promotion or prize draw created by a user. If you use it for such an activity, you alone are responsible for:
- publishing accurate eligibility rules, odds disclosures, entry periods, prize descriptions and winner-selection procedures;
- complying with laws, licences, registrations, permits, age restrictions, platform rules and tax obligations;
- obtaining required consents and avoiding misleading, unfair or deceptive practices;
- verifying entries and winners, keeping any required audit records, and resolving disputes; and
- providing prizes and honouring the promotion as advertised.
You must not use the Service for illegal gambling, betting, money laundering, unlicensed lotteries or any arrangement that is unlawful where it is offered or entered.
7. Storage modes and your responsibility for backups
7.1 Draft and browser storage
Drafts and wheels saved to “this browser” are stored locally using browser storage. They generally remain on that browser and device and are not automatically available elsewhere. Private browsing, clearing cookies or site data, browser cleanup, storage pressure, browser settings, extensions, device loss or replacement, and software updates may erase or block local data. SpinIt cannot recover browser-only data that never reached SpinIt's systems.
7.2 Local .spinit files
Downloading a .spinit file creates a file for you to store and later import. You are responsible for its location, confidentiality, integrity, compatibility and backups. Anyone who obtains the file may be able to view its contents. Do not treat the format as encrypted unless the Service expressly states that it is.
7.3 Cloud storage
Signed-in users with an active account may save private wheels and supported assets to SpinIt's cloud systems. Cloud features require a working connection and may be temporarily unavailable. Save As creates a separate wheel; Overwrite replaces the selected saved wheel. Conflicts between browser tabs or devices may require reloading before an overwrite can complete.
7.4 Backups and export
You should keep independent copies of important wheels and records. Although SpinIt uses safeguards designed for the Service, it does not promise permanent storage, archival retention or recovery of every item. Do not use SpinIt as the only repository for irreplaceable, legally required or mission-critical information.
8. Limits, quotas and fair use
The Service may apply limits to saved wheel count, entry count, file types, file size, cloud media, public shares, requests, reports, analytics events and other resource use. Current limits may be shown in the interface, Help Centre, plan description or account usage page. At the effective date, the browser and Free cloud destinations each support up to 20 saved wheels; media and sharing allowances are separately enforced by the Service.
Overwriting an existing wheel may not use a new wheel slot, but changed or added media may still count toward storage allowances. Deleting a wheel or share may not reduce measured usage instantly while safe cleanup is completing. Guest sharing may use a separate allowance and human-verification process.
You must not evade limits by automation, multiple accounts, manipulated sessions, repeated guest identities or other technical workarounds. We may reasonably adjust limits, introduce plan-based entitlements, or restrict unusually heavy use to protect security, reliability and other users. Where a change materially reduces a paid entitlement, the paid-plan terms and applicable law will apply.
9. Public sharing
When you create a share link, SpinIt publishes a snapshot of the current wheel. Anyone who has or receives the link may load, view, spin and copy that snapshot without signing in. A link should be treated as public, even if it is difficult to guess or marked noindex. Search engines, messaging services, social networks, browser previews or recipients may store, preview, index or redistribute content despite technical controls.
A snapshot does not automatically update when you later edit the original wheel. You may need to create a new link for significant changes. Depending on the current feature behaviour, supported images may be copied into managed public-share storage so recipients can view them.
Signed-in owners may be able to list and revoke links associated with their cloud wheels. Guest links may not be manageable in the same way. Revocation prevents future retrieval through SpinIt but cannot remove copies, screenshots, cached previews, downloads or onward disclosures already made by others.
Shared links may expire, be revoked, be disabled after the source is deleted, or become unavailable because of moderation, account restrictions, retention rules, security measures or service changes. Do not promise recipients that a link will remain available indefinitely.
10. User Content and permissions you grant
“User Content” means wheel titles, descriptions, entries, weights, colours, images, uploaded files, profile information, shared snapshots, messages, reports, feedback and other material you submit through the Service. You retain any ownership rights you have in your User Content.
You grant SpinIt a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, adapt for technical purposes, transmit, display and otherwise use User Content only as reasonably necessary to operate, secure, improve and support the Service; comply with your sharing and storage choices; enforce these Terms; and comply with law. This licence lasts while the relevant User Content is stored or shared, plus a reasonable period for backups, security, dispute resolution and lawful retention.
For a public share, the licence includes making the snapshot and its supported assets available to anyone with the link. You represent that you have all rights, permissions and lawful bases needed to submit the User Content and grant this licence.
11. Personal information in wheels
Wheel entries can contain personal information. Before entering or sharing names, images, contact details or other information about another person, you must have a lawful reason and any consent or notice required in your context. Use the least information necessary; initials, roles or non-identifying labels may be more appropriate than full names.
Do not place passwords, financial account details, government identifiers, precise private addresses, medical records, confidential student records, highly sensitive information or secrets in a wheel. Do not publish personal information that could expose a person to harassment, discrimination, identity theft or physical danger.
Educators, employers, event organisers and other organisations are responsible for their own privacy notices, permissions, retention rules and responses to individuals whose information they enter. SpinIt does not become responsible for your independent collection or use of that information merely because you use the Service.
12. Prohibited content and conduct
You must not use the Service to create, upload, store, share, promote or facilitate content or conduct that:
- is unlawful, fraudulent, deceptive, defamatory, threatening, violent, harassing, hateful or intended to intimidate or humiliate;
- sexually exploits or endangers a child, sexualises minors, grooms a minor, or otherwise creates a child-safety risk;
- contains non-consensual sexual content, unlawful sexual content or serious privacy violations;
- exposes personal data without authority, doxxes a person, impersonates another person, or enables identity theft;
- offers illegal goods or services, supports unlawful gambling, or facilitates fraud, phishing, scams or money laundering;
- contains malware, harmful code, unsafe links, credential theft or instructions intended to compromise systems;
- infringes copyright, trade mark, privacy, publicity or other rights;
- is spam, mass unsolicited promotion, artificial traffic or abusive automation;
- manipulates or attacks the Service, bypasses access controls or quotas, probes vulnerabilities without permission, or interferes with another user's access;
- scrapes, reverse engineers or extracts protected portions of the Service except to the extent applicable law expressly allows; or
- uses the Service or its outputs to train, benchmark or build a competing service through automated or bulk extraction without SpinIt's written permission.
You also must not misrepresent an equal-chance wheel when you have enabled unequal weights, falsify a result, or use deceptive presentation to make a drawing appear fair when it is not.
13. Reporting, moderation and enforcement
Users can report a public shared wheel for categories such as threats or violence, harassment, personal-data exposure, fraud or phishing, sexual content, child safety, illegal goods or services, malware, copyright infringement, spam or another policy violation. You may also contact contact@spinit.to about abusive shared content.
We may investigate reports and use automated and human review. We may preserve relevant records, restrict distribution, disable or revoke links, remove content, limit features, suspend or ban accounts, block sessions or devices, or refer matters to competent authorities where reasonably necessary. We may act without advance notice when urgency, safety, security, legal duties or evidence preservation requires it.
Moderation involves judgment and may not detect every violation. SpinIt does not endorse User Content and is not responsible for screening all content before it appears. Submitting false, repetitive or abusive reports is prohibited and may be rate-limited or sanctioned.
14. Intellectual property in the Service
The Service, including its software, interface, designs, branding, graphics, documentation and original content, is owned by SpinIt or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
Subject to these Terms, SpinIt grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Service for lawful personal, educational and internal business purposes. You may not sell, sublicense, copy substantial parts of, frame, mirror, white-label or commercially exploit the Service unless SpinIt gives written permission or a plan expressly allows it.
SpinIt names, logos and related marks may not be used in a way that suggests sponsorship, endorsement or affiliation without permission. Third-party names and marks belong to their respective owners.
15. Feedback
If you send suggestions, ideas or feedback, you allow SpinIt to use them without restriction or payment. This does not transfer ownership of your unrelated User Content or confidential information, and you should not submit feedback that you are not authorised to share.
16. Privacy, cookies and analytics
SpinIt's handling of personal information is described in its Privacy Policy, and its use of cookies and similar technologies is described in its Cookie Policy and privacy-choice tools. Those documents are incorporated by reference to the extent applicable.
The Service may collect limited operational, security and product analytics, such as page views, spin context, entry count ranges, whether media or weights are used, share-channel selections, error information and correlation identifiers. The Service is designed not to include wheel entry names or sensitive wheel snapshots in routine analytics by default. Do not attempt to send sensitive or arbitrary data through analytics interfaces.
17. Advertising and third-party services
SpinIt may be supported by advertising, including advertising supplied by third parties such as Google. Advertising providers may use cookies or similar technologies subject to your choices, applicable law and their own policies. An advertisement does not mean SpinIt endorses the advertiser, product or claim.
The Service depends on third-party infrastructure and may link to or integrate with services for hosting, cloud storage, authentication, email, human verification, analytics, social sharing and advertising. Those services may have separate terms and privacy policies. SpinIt is not responsible for third-party sites, content, availability or acts, but this does not limit responsibility that cannot lawfully be excluded.
When you choose a social sharing button or your device's native share menu, you direct information to the selected platform or application. Review the destination and content before sending.
18. Free Service and future paid plans
Core features are currently offered free of charge, subject to limits and these Terms. SpinIt may later introduce optional paid plans, purchases or premium features. Before charging you, SpinIt will show the applicable price, currency, taxes or additional costs, billing period, payment method, main features, renewal and cancellation terms, and any refund rights required by law.
A paid transaction will not be complete until accepted and acknowledged through the applicable checkout or confirmation process. You must provide accurate billing information and are responsible for authorised charges. Unless a checkout says otherwise, free features do not create a promise that every current feature will always remain free.
Nothing in these Terms removes any mandatory cancellation, refund, repair, re-performance or other consumer remedy that applies to a paid service.
19. Service availability, maintenance and changes
We aim to keep the Service useful and available, but do not promise uninterrupted or error-free operation. The Service may be unavailable because of maintenance, updates, outages, security events, network or provider failure, capacity limits, legal requirements or events outside reasonable control.
We may add, change, suspend or discontinue features and may update supported browsers, file formats, limits and technical requirements. Where reasonably practicable, we will give notice of material changes that negatively affect paid users or stored cloud content. You are responsible for exporting content you wish to keep before a stated discontinuation date.
20. Suspension and termination by SpinIt
We may restrict, suspend or terminate access, revoke public links, or remove User Content if we reasonably believe you violated these Terms; created legal, safety, fraud or security risk; exposed another person's data; failed to pay an authorised charge; repeatedly exceeded limits; or if action is required to protect the Service or comply with law.
Where appropriate, we may provide notice and a chance to correct the issue. We are not required to restore removed content or access. You may contact support@spinit.to if you believe a restriction was imposed in error.
21. Ending your use and account deletion
You may stop using the Service at any time. Deleting browser data or uninstalling a browser does not delete cloud data. Signed-in users may use the account deletion control under My account > Sign-in & security, subject to identity verification and any retry process shown by the Service.
A completed account deletion is intended to remove private cloud wheels, revoke shared wheels, delete managed uploaded objects and remove the sign-in identity. Certain security, fraud-prevention, legal, transaction or dispute records may be retained where permitted or required, and retained security records may be anonymised. Backups may persist for a limited period before being overwritten.
Deleting an account or revoking a link does not retrieve copies previously exported, downloaded, cached, screenshotted or shared outside SpinIt. Browser-only data remains under the control of each browser or device and may need to be removed locally.
22. Disclaimers
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. SpinIt does not make promises about uninterrupted availability, permanent storage, compatibility with every device, error-free operation, the legality of your particular use, or the accuracy, reliability or suitability of User Content or results for your purpose.
SpinIt does not provide legal, financial, medical, gambling, contest-administration, educational assessment or other professional advice. You are responsible for obtaining professional advice and independent safeguards where appropriate.
No disclaimer in these Terms excludes an express commitment made in a paid offer or a guarantee, condition, warranty, duty or remedy that applicable law does not allow SpinIt to exclude.
23. Limitation of liability
To the maximum extent permitted by law, SpinIt and its owners, personnel, affiliates and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profits, revenue, opportunity, goodwill, data or business interruption, arising from or related to the Service, even if the possibility was known.
To the maximum extent permitted by law, SpinIt's total aggregate liability arising from or related to the Service will not exceed the greater of: (a) the amount you paid SpinIt for the Service during the 12 months before the event giving rise to the claim; or (b) USD 50. This cap does not apply where prohibited by law, or to liability that cannot legally be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.
You are responsible for reasonable measures that reduce loss, including reviewing settings, keeping backups, testing a wheel before a live event, verifying high-impact results and stopping use when an error is apparent.
24. Your responsibility to SpinIt
To the extent permitted by law, if your unlawful User Content, deliberate misuse of the Service, infringement of another person's rights or material breach of these Terms causes a third-party claim against SpinIt, you will be responsible for the resulting reasonable losses, liabilities and legal costs. This section does not require a consumer to compensate SpinIt for losses caused by SpinIt's own breach, negligence or unlawful conduct, and it applies only to the extent it is fair and enforceable under applicable law.
25. Governing law and disputes
These Terms and any non-contractual dispute arising from them are governed by the laws of Malaysia, without regard to conflict-of-law rules. This choice does not deprive you of mandatory protections available under the law of your country of residence.
Before starting formal proceedings, you and SpinIt should first try in good faith to resolve the issue by contacting support@spinit.to and providing enough information to understand the dispute. This informal step does not stop either party from seeking urgent relief or using a consumer protection authority, tribunal or small-claims process where available.
Subject to any mandatory right to bring a claim elsewhere, the courts of Malaysia will have non-exclusive jurisdiction. These Terms do not require arbitration and do not waive rights to participate in a class or representative action where such a waiver would be unlawful.
26. Changes to these Terms
We may update these Terms to reflect changes in the Service, law, security practices or business operations. The updated Terms will state a new “Last updated” date. If a change is material, we will use a reasonable method of notice, such as a notice on the Site, in the account area or by email.
Changes apply prospectively from their stated effective date. If you continue using the Service after the updated Terms take effect, you agree to them. If you do not agree, you must stop using the Service and may delete your account. Where applicable law requires express consent, we will request it.
27. Electronic communications
You agree that notices, confirmations, disclosures and other communications relating to the Service may be provided electronically through the Site, account interface or email. You are responsible for keeping your email current and checking notices. Electronic communications do not replace any form of service or notice that applicable law requires to be delivered differently.
28. General terms
- Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy and any feature-specific or paid-plan terms presented to you, form the agreement about the Service and replace earlier understandings on the same subject.
- Order of precedence. Feature-specific or paid-plan terms control only for that feature or transaction if they expressly conflict with these Terms. Mandatory law always controls where it cannot be varied.
- Severability. If a provision is held unlawful or unenforceable, it will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue.
- No waiver. A delay or failure to enforce a provision is not a waiver. A waiver must be clear and applies only to the specific instance.
- Assignment. You may not transfer your account or these Terms without SpinIt's consent. SpinIt may transfer these Terms as part of a reorganisation, financing, merger, sale of business or transfer of the Service, subject to applicable law and continued protection of your rights.
- No partnership. These Terms do not create employment, agency, partnership, joint venture or fiduciary relationship between you and SpinIt.
- Force majeure. Neither party is responsible for delay or failure caused by events beyond reasonable control, except for payment obligations already due and responsibilities that applicable law does not allow to be excused.
- Headings and language. Headings are for convenience. “Including” means “including without limitation”. If a translated version is provided and local law permits, the English version controls in case of inconsistency, unless the translation expressly states otherwise.
